The health index is a crucial economic indicator in Belgium, especially for the annual adjustment of rents, or rent indexation. To understand its essence, it is first necessary to highlight its link with the consumer price index (CPI)

Legislative framework regarding indexation

The Consumer Price Index (CPI).

The Consumer Price Index (CPI) acts as a barometer for the price evolution of all goods and services within Belgium. It reflects the evolution of the cost of living, also called the “index basket. A rising CPI indicates inflation, while a fall (a rare phenomenon) indicates deflation.

The Health Index: A refined measurement

The health index, introduced in 1994, is a derivative of the consumer price index, excluding the prices of specific product groups. These include:

  • Tobacco
  • Alcoholic beverages
  • Gasoline
  • Diesel

This exclusion was introduced at the time to curb the impact of rapidly rising prices of these four products on rent indexation and thus moderate rent increases. Currently, the health index is the primary indicator for calculating rent indexations.

Publication and structure of the Health Index

The Federal Public Service Economy (FPS Economy) publishes the health index, like the consumer price index, monthly, usually around the 25th of the month.

For simplified rent indexation calculations, the government periodically fixed the index at 0 or 100, including in 2004 and 2013. Hence the terms “base index 1996,” “base index 2004,” and “base index 2013.

How is rent indexation calculated using the Health Index?

The calculation of rent indexation requires two specific health indexes to be applied on the annual anniversary of the lease:

  • The Base Index: This is the index of the month preceding the date the lease is signed or becomes effective. The exact reference date may vary by region.
  • The New Index: This is the index of the month preceding the annual anniversary of the lease.

What if the Health Index drops?

If the health index falls below the base index, resulting in a negative rent indexation, the tenant has the right to request the owner to reduce the rent to the level determined by the formula. However, the rent can never fall below the original base rent
